There have been major developments in the custody case between Olivia Wilde and Jason Sudeikis.

In new court documents that have been released pertaining to the custody of Jason and Olivia’s two children Otis, 8, and Daisy, 5, it was revealed that Olivia fired back at her ex about the way she was served custody papers.

The actress was served the papers at Cinema-Con as she was presenting her movie, Don’t Worry Darling, on stage in front of a big audience. Now, in the court filings, the director accused Jason of malice with the highly public move:

“Jason’s actions were clearly intended to threaten me and catch me off guard.

He could have served me discreetly, but instead he chose to serve me in the most aggressive manner possible.”

Olivia, who was infamously interrupted on stage when she was served, went on to say:

“The fact that Jason would embarrass me professionally and put our personal conflict on public display in this manner is extremely contrary to our children’s best interests.

Since Jason has made it clear that we will not be able to work this out for our children’s sake outside of the court system, I filed a petition for custody in Los Angeles.”

The former couple and their two children had been residing in London since December 2021. But then Jason planned to return to New York City in the summer after completing work on Ted Lasso, and he wanted to bring the kids with him. Olivia said in her motion to dismiss Jason’s petition:

“When I did not agree, since the children have not lived in New York for several years, Jason filed these papers.”

In Jason’s filing, he explained why he served Olivia custody papers:

“First, Olivia said that if I did not reside full-time in Los Angeles, she would allow me to spend time with Otis and Daisy on weekends and during vacation periods – thus depriving me of my right to parent the children during important periods of their lives…Second, Olivia said that she intended to relocate with the children to London following the close of school in 2023.”

As for why the docs were served in such a manner, he said:

“I did not want service to take place at the home of Olivia’s current partner because Otis and Daisy might be present. I did not want service to take place at the children’s school because parents might be present.”

He stated that the process server was not able to serve Olivia with the papers at the intended place and so made other plans:

“I understand that the process server had only done her job; however, I deeply regret what happened. Olivia’s talk was an important event for Olivia, both professionally and personally, and I am very, very sorry that the incident marred her special moment.”

In other developments, Jason’s custody petition has been dismissed this week following the judge’s ruling that their children’s home state is California.
